Australian Digital Forensic Laws

Hi,

I am trying to find resources regarding digital forensic laws in Australia. I have had an opportunity to perform digital forensics for a small company. I am considering starting a business that mainly consults to small to medium sized businesses. While I have the knowledge to appropriately secure, image and investigate digital data I do not want to break any laws while doing so. Is anyone able to direct me to any resources regarding Australian Law.

You'll need to specify a state since most of the relevant laws are state based in Australia. As a general principle, if you're doing forensics on computers belonging to a business, at the request of the business, you don't need any specific licensing. Same thing if you're working under a court order. That's based on Queensland law which I'm most familiar with being a Queenslander myself.

Obviously you should obtain independent legal advice since I'm not a lawyer and this is not legal advice.

Thanks for the reply. I had a feeling that may be the case for businesses.
For further replies. The states I am interested in are the ACT(Canberra) and New South Wales.
