An appeal for help and maybe some adice!

Good Evening All,
While not specifically related to Forensics, this still may interest a few of you, and I am wondering if anyone else may have had similiar experiences, and how it was handled.

For starter, I own a forensic website that some of you may have visited in the past:
www.e-evidence.info

In the last few days, I have had what became a rather unpleasant exchange of emails w/ an individual that decided to 'plunder' the contents of my site.

For those of you interested in reading this exchange, it is linked off of the homepage of my site.

In response to my requests that the copyrighted materials be removed, rather than removing my content, he has chosen to reformat and 'rearrange' it, making it less identifiable as my content.

At this point, I am not sure if there is any recourse. Any guidance or advise would be welcome.

Hello,

I love your site and check there during the month but make sure and check on the 1st of the month when updates occur.

The exchange of emails on his part seems weird at best. Not many attorneys I know would offer advice and tell you to post their advice. They are in business to make money (as we all are) and would most certainly backchannel you or send some sort of a cease and desist letter to you or the admin of the page as listed by the registrar.

Is he in England?

And thanks for the kudos on the site Smile
As of right now, I haven't determined exactly where he is.
But, he attended school in Canada, so I am assuming he is Canadian.
And whois brings back InfoSysSec, West Chester, Pennsylvania.
I have decided to take all possible actions to defend my rights.
I have been told I can get the college's lawyer to write the 'Cease and Desist' Letter, but nothing beyond that (I hold the copyright, not the college)
I intend to contact his advertisers, his ISP, and the major search engines to inform them of his DMCA violation.

Can anyone think of anything else?

Taking it out of the virtual world on to paper IMHO is the best thing you can do. While we are all mostly paperless now, a cease and desist order either served on him or sent certified mail (sounds like he may not accept) should go a long way to helping.

Getting the name of his counsel and having the letter go straight to his counsel might also be helpful. If he decides to not give you his counsel name, well you know what he is probably full of hten.

Hope it all works out for you, your site is really a very important part of the community.

LET ME ANALYSIS IT FROM A PSYCOLOGICAL STANDPOINT:
(be warned i'm posing this just after reading few lines of your email)

i'm NOT taking side of anyone instead just speaking my openion.

moral: MOST OF THE WORLDS PROBLEMS HAD NEVER BEEN SOLVED WITH GUNS

The person (theaf Smile seem to have a NICE portal for sharing information and basically he must have copied most of its contents from somewhere else since ages. That concludes its his habbit (maybe hobby) and after getting such a sweeeeeeeet compilation there is a very thin chance he would have rewrite/removed it on your email.

On first go... your email;
"Your are in violation of COPYRIGHT!!! "

and later followed by "To Whom it May Concern"


"It is a blatant rip-off! So, I am ready to proceed with a DMCA violation if this is not remedied IMMEDIATELY!!! "


AGREED! AGREED! AGREED!

but if i were you i'd have contacted him with a diplomatic approach rather than legal or forensic mindset. Maybe i'd have emailed him by thanking him for using/spreading your contents and sharing it with rest of the world. maybe i would have pointed few more places from where he could refer more stuffs and later in the email i'd have asked him write a small note on the top of the page; compiled from "YOUR ORIGINAL WEBSITE" so that you could get proper credits for your effort and compilation and maybe clear doubts to yours and his website its YOUR ORIGINAL CONTENT WHICH SOMEONE HAD COPIED to share it with rest of us.

I've seen so many times, approaching a stranger with the warmth and welcome like you have known him for ages..... will echo back same friendliness + his obligations to act upon your request as you have just BONDED WITH HIM.

abt again thats just me n my approach.........

I appreciate your feedback, and I do agree that 'honey attracts more than vinegar.'
But, that being said, the amount of work that goes into building and maintaining www.e-evidence.info, then seeing the majority of it posted on another site, horrified me.
Plus the fact that he had done it in the past...

The reason I built my site was to share. And there are MANY other sites out there that appreciate and acknowledge my site with recommendations, and a LINK. I was never asked or notified that 26 webpages were to be aggregated and posted somewhere else. So, courtesy was not in the cards Smile

I intend to persue this matter to the fullest. I will continue posting updates on my site.

If someone said

to me, I would most certainly know it was sarcasm and it would make me more agitated.
