Data recovery at home - legal aspects

Hey, could someone shed some light please…

What issues could arise with recovering persons data for them as a service..at my own home? I would assume the DPA act would kick in..but as long as I destroy the data as soon as I've finished with it i'm assuming i'm safe.

Any comments would be useful

In the same situation, I informed my local police of my activities. They told me what I should do if I come across CP.

In the US I see no particular reason why one could not conduct a business, in a well established and delineated area in your home.

I wonder what are the requirements to conduct business in your garage in the UK?

You should be OK as long as proper chain of custody documentation is observed and there is a secure (safe, locked, keyed closet, etc) area to hold evidence. As far as finding illegal content, you should contact your local authority and let them know of your operation and ask how they would like you to proceed if a situation occurs.

UK garages are rather smaller than US ones, it not a common practise this side of the pond.

The only thing that I would be sure to do is have sufficient environmental protection (fire, water, electrial, heat, cold, EMF, etc.), so that you are not at risk of permanently losing your clients' data.

You can get a safe which can do most of that but good data safes are not cheap.

Good safes. But note that most of them are rated at 2 hrs. so make sure that you have fire protection.

The one rule in this business is that the thing that you think will never happen always does. If it didn't, you wouldn't be thinking of it.

If possible, place it some place where it could easily be moved if need be, preferably first floor. A typical house fire can get to 1000 degrees celcius or higher so you want to locate it in a place that is easy to evacuate.

In the US you would want to Incorporate to maintain separation between your personal assets and your company assets. Location is immaterial as long as you set and maintain protocol.
