While the document leak is new, the policy is not new. Most of this has been covered if you ever have had to fire off a subpoena and you quickly learn what is covered by that and what requires court orders, etc.
I believe Google is traveling down the same path and I can't think of anyone who uses hotmail for anything other than an account to dump emails which are of little importance.
