This is something we are seeing more as more people "get into" CF, making promises, egtting a hefty upfront fee and then not being able to deliver. Sometimes this is because they don;t know what is possible before they start a job.

This must be an on the side deal, Cherry's rep doesn't sound like it would allow this kinda behavior. I'd talk to the in charge guy over there.

The computer was sent there the 13th, my mom had a meeting with the guy doing it the 18th just to explain what he should be looking for, we havent heard since then?

Hmmm. Not happy to hear that it's really Cherry. A $1000 seems a little small for them and what they are doing. As for the judicial process (and of course disclaimer I am not an attorney and this advise is not legal advise, and anything I say is taken as some dude's opinion.)

Generally business documents - billing information, service address, names, etc - are only accessible via subpoena, either via criminal or civil process. Without a PD case number and a detective obtaining a subpoena ducus tecum or an attorney obtaining an order from a judge Comcast will not release information pertaining to an IP.

Since she took it to Cherry I assume you live in the Metro-Atl area? If there is a criminal matter - depending on your sister's age and what statements were made - there may be ground for a criminal action. Then, the detective would pursue the matter with Comcast. If you're in Cobb, Fulton, Gwinnette, Forsyth, Cherokee, or Atlanta - those folks are pretty good. If it's criminal they can help.

Honestly, it's a "home front" issue. I teach school kids, parents and school administrators about online predators. Your parents and your sister just need to keep HERSELF from being a victim. That way you stop her behavior; there are so many people out there looking for victims that, sure you might find this dude, but there's another one willing to take his place.

Thanks for your help, I didnt even want her to bring it there because she has no case…all it is, my sister who is in college has been talking to someone on myspace for about a year and now she thinks hes not who he says he is, so my mom freaked, i dont think that will stand up as any case to cause then to subpoena comcast or myspace for info because she was involved and nothing wrong was going on its wasnt a violent thing she liked talking to him its just he was lying about things., and yes we are in the metro area, cherry cant issue the subpoena right? that would have to come from an attorney? i told her to just stay off the computer and issue is solved i think its all silly but my mom doesnt understand that.

You are correct. There are no grounds for a subpoena. As cool as Cherry Systems is they still can't get a subpoena. Last I checked the Georgia Code lieing isnt illegal. Sorry your folks blew a grand.

Yeah I knew they did it, it still doesnt make sense to why it was $1000 and still have not heard anything when it says 3-4 days, there is no case to be had so I still see this as a pointless thing…how long would a subpoena take if they were able to get one?

They CAN NOT get one. Only lawyers or law enforcement. Cherry would need to be retained by YOUR lawyer - but you don't have one. That lawyer would have to file a lawsuit in court, and then ask for a subpoena for the production of records from the judge to Comcast. As for time, it depends on the civil process in your county.
