There was a nice hour or two discussion about this topic on CSPAN2, and the idea of this seems to bother a great number of people.

The way things appear to be heading is to have the chance to catch any "future" criminal as opposed to the here and now actions that may be the focus of a current investigation.

As far as the data goes, criminal and civil cases seem to be able to have access to to it equally as opposed to just LE.
