surely if he has been found guilty then there has been a forensic analysis of the machine already done with the files detailed in the report so you should know that there are no more files hidden or it wouldn't have been a very good forensic investigation?

In my experience, this is not always the case, i.e., I have seen cases where the search ended as soon as there was enough evidence to get the appropriate verdict, and was not comprehensive. In any event, it is not something that I would risk, that is to say, I would not rely on the prosecution's expert report to identify all of the infringing materials.

yes, you are spot on with that last point but the report for the court was carried out by another firm and, for reasons I am yet to work out, I do not have access to their report.

well I spoke to the client and downgraded their expectations. I think it's hard for non experts to understand how hard it is to fully remove all traces of this data (for example, he had not even considered thumbnails, temo files etc etc).

hmmm interesting….

Are they trying to destroy evidence or did they get notice from the copyright owner that said they have to remove all instances of the copyright material from their systems. I have run into both.

In the first case - stay away from it.

If it is based on a request from original owner, I would tell them to get you to image the 3 PCs first and then use a program like ERASER to wipe the files clean and then clean up unallocated. If the request is from the owner, maybe the owner can tell you what files you need to erase which would be accepted by them as following through on their request.

Regardless, make sure your contract specifies that you can not guarantee that all related files and supporting files are found and deleted and that they can not hold you liable if a temporary file or something is found later, and that you will make good faith effort in getting rid of the files.

Just some thoughts… hope it helps….

Can you go back to the court and as for clarification, and provide various technical options?

I would rather get a letter from the judge saying "I want option B", then me deciding, and then get dragged back to court because little Jimmy's WoW hack no longer works…

… And as others have suggested it, why are you responsible for this in the first place?
