Thanks for the reply. Right now this is a hypothetical scenario, but I think its a learning oportunity none the less. I never really thought of sending a search warrant to the service provider of where I thought or knew the texts were coming from.
Asking about the SMSC, what it holds, how it holds it and for how long are good questions to ask.

Speaking just about New York this would require a wiretap/eavesdrop warrant or on the Federal level a Title III warrant. Trying a search warrant for live communication after seizure would be forbidden in NY.
