The emphasis on copying and transferring files might harvest useful evidence if a separate list is maintained when copying has occurred and an attempt to copy to a destination (folder) is maintained in the Conflict Resolution dialogue.
There might also be some re-newed discussion about corroborating intentional deletion. Do any of you remember the case of R .v. There's none announced - but given you can pause and resume copy operations I am assuming it will be hidden in a jumplist somewhere.
Of course, it's possible it's not going to be stored anywhere, but a man can dream, right? )
*dreams of a "history of copied files" list, along with timestamps and thumbnails, in Windows 8 AppData*
