I personally don't believe there needs to be any enhanced requirements for cell phone tracking. I've only had to do this a few times, Once in an alleged kidnapping case and twice in a fugitive case. The two fugitives had active felony warrants which were issued after having established probable cause and getting a Judges signature.
If I abuse my authority and start tracking innocent people then I am commiting a Federal Crime and should be punished. I wonder if Wyden is going to try and extend this legislation to historical tracking (Cell Site Sector, RTT, PCMD, timing advance, etc) or is he only looking to apply this to real time?
In a way I would liken this to arguments I have heard in the past that say we need more gun laws when all we really need to do is enforce the ones that are already on the books.
